Analysis of Laws Regarding Information and Communication Technology on the Advertisings Violating Health Products Laws

Abstract

Objective: To analyze laws regarding information and communication technology (ICT) applicable for the cases of advertisings breaking health product laws. Method: The study was documentary research. The researcher analyzed the Acts mainly under the Ministry of ICT having the contents on consumer protection. Results: The study identified 2 applicable laws including the Act on Organization to Assign Radio Frequency and to Regulate the Broadcasting and Telecommunications Services B.E. 2553, and the Computer Crimes Act B.E. 2550. The first has a Notification directly relevant to consumer protection i.e., the Notification of the National Broadcasting and Telecommunication Commission (NBTC) on actions considered as exploitation of consumers in the area of broadcasting and television B.E. 2555. The Notification included a provision to penalize the operators of radio or television broadcasting networks who unlawfully advertised health products. However, the Notification included no provision to penalize manufacturers, sellers and owners of the advertised products. Legal actions based on this law against the operators of radio or television broadcasting networks could be initiated only after the proceedings based on laws governing specific health products against manufacturers, sellers and owners of the advertised products had been taken and the NBTC was informed on wrongdoings. Computer Crimes Act B.E. 2550 was relevant to illegal advertising of health products over internet in the investigation to find offenders or evidences in computer system for taking legal actions according to specific health product laws. Conclusion: The researcher provided suggestions and approaches to competent officers and regulatory agencies in enacting the measures in ICT laws for a better control of unlawful advertisings of health products.
