การวิเคราะห์ข้อกำหนดท้องถิ่นที่ออกตามกฎหมายสาธารณสุขเพื่อ ควบคุมความปลอดภัยด้านอาหารในอำเภอป่าซาง จังหวัดลำพูน

บทคัดย่อ
วัตถุประสงค์: เพื่อวิเคราะห์ข้อกำหนดของท้องถิ่นในอำเภอป่าซาง จังหวัดลำพูนที่ออกเพื่อความปลอดภัยด้านอาหาร และเพื่อเสนอข้อกำหนดและแนวทางร่วมในการดำเนินงานความปลอดภัยด้านอาหารระหว่างองค์กรปกครองส่วนท้องถิ่น (อปท.) หน่วยงานด้านสาธารณสุข และหน่วยงานอื่นที่เกี่ยวข้องในอำเภอป่าซาง วิธีการ: ผู้วิจัยวิเคราะห์ข้อกำหนดที่เกี่ยวกับอาหารปลอดภัยของ อปท. 8 แห่งในอำเภอป่าซาง และนำมาเปรียบเทียบกับสารบัญญัติที่สำคัญของพระราชบัญญัติการสาธารณสุข พ.ศ. 2535 และฉบับเพิ่มเติม การศึกษายังได้สัมภาษณ์เชิงลึกในผู้กำกับดูแลกฎหมายของ อปท. 18 คน ผู้วิจัยวิเคราะห์ข้อมูลเพื่อให้ทราบถึงการดำเนินการตามกฎหมายของ อปท. และการทำงานร่วมกันของภาคีเครือข่ายในอำเภอป่าซาง เพื่อหาข้อเสนอแนะแนวทางในการดำเนินงานด้านอาหารปลอดภัยของอำเภอป่าซาง ผลการศึกษา: ข้อกำหนด เรื่อง กิจการที่เป็นอันตรายต่อสุขภาพมีใน อปท. ทั้ง 8 แห่ง ข้อกำหนดเรื่องตลาดและข้อกำหนดเรื่องสถานที่จำหน่ายอาหารและสะสมอาหารมีใน อปท. 5 แห่ง และเรื่องการจำหน่ายสินค้าในที่หรือทางสาธารณะมีใน อปท. 1 แห่ง ในการวิเคราะห์สารบัญญัติที่สำคัญ พบว่า ข้อกำหนดของ อปท. เรื่องกิจการที่เป็นอันตรายต่อสุขภาพใน อปท. เพียง 2 แห่งมีความสอดคล้องกับกฎหมายหลักและมีการปรับปรุงแก้ไขให้เป็นปัจจุบัน ส่วนเรื่องตลาด สถานที่จำหน่ายอาหารและสะสมอาหาร และการจำหน่ายสินค้าในที่หรือทางสาธารณะของทุก อปท มีความสอดคล้องกับกฎหมายหลัก จากการสัมภาษณ์ผู้กำกับดูแลกฎหมายพบว่า ข้อกำหนดท้องถิ่นจะออกเมื่อมีปัญหาในท้องถิ่น ขนาดของปัญหาที่มากและรุนแรง และสภาพของกฎหมายหลักที่กำหนดให้ออกข้อกำหนดเป็นสิ่งสำคัญในการกระตุ้นให้มีข้อกำหนดท้องถิ่น อปท. ดำเนินงานคุ้มครองผู้บริโภคด้านผลิตภัณฑ์สุขภาพตามกรอบภารกิจร่วมกับโรงพยาบาลส่งเสริมสุขภาพตำบล อปท. ทุกแห่ง ทราบว่า เรื่องอาหารปลอดภัย เป็นปัญหาสุขภาพในพื้นที่ แต่ยังไม่เห็นกิจกรรมที่เป็นรูปธรรมชัดเจน สรุป: อปท. ในอำเภอป่าซางทุกแห่ง ควรออกข้อกำหนดของท้องถิ่นในเรื่องกิจการที่เป็นอันตรายต่อสุขภาพและเรื่องสถานที่จำหน่ายอาหารและสะสมอาหาร ส่วนในเรื่องตลาด และการจำหน่ายสินค้าในที่หรือทางสาธารณะนั้น การออกข้อกำหนดควรขึ้นกับสภาพปัญหาของพื้นที่ นอกจากนี้ ควรมีการแลกเปลี่ยนเรียนรู้ระหว่าง อปท. และเจ้าหน้าที่สาธารณสุขในเรื่องความรู้ด้านกฎหมายสาธารณสุข ความรู้เรื่องการคุ้มครองผู้บริโภคด้านผลิตภัณฑ์สุขภาพ และกฎหมายที่เกี่ยวข้อง และหาแนวทางในการบูรณาการการดำเนินงานความปลอดภัยด้านอาหารในอำเภอป่าซาง
