Analysis of Local Regulations Issued under the Public Health Law for Controlling Food Safety in Pasang District, Lamphun

Abstract
Objectives: To analyze local regulations in Pasang district, Lamphun for controlling food safety and to propose regulations and guidelines for collaborations in food safety among local administrative organizations (LAOs), public health agencies, and related organizations in Pasang district. Method: The researchers analyzed the local regulations on food safety of 8 LAOs in Pasang District and compared to key content of the Public Health Act B.E. 2535 and amendments. The study also conducted in-depth interview with 18 regulators in LAOs. The researchers analyzed the data to reveal implementation of the regulations of LAOs and collaborations among LAOs in Pasang district in order to formulate suggestion on guidelines for the control of food safety in Pasang district. Results: Regulations on activities considered hazardous to health were available in all 8 LAOs. Those on market and establishments for food distribution and storage were available in 5 LAOs, while that on distribution of products in public places was available in 1 LAO. Analysis of important legal provisions revealed that the regulations on activities considered hazardous to health of 2 LAOs were consistent with the main laws and revised to be up to date. Those on market and establishments for food distribution and storage in LAOs were consistent to the main law. Interview with legal regulators found that local regulations would be issued to respond to the local problems. Magnitude and severity of the problems, and nature of the main law mandating the issuance of local regulations were important in motivating proposal of local regulations. LAOs conducted activities on consumer protection according to framework of work in collaboration with sub-district health promotion hospitals. All LAOs perceived food safety as a local health problem, however, there were no concrete activities to mitigate the problem. Conclusion: All LAOs in Pasang district should issue local regulation on activities considered hazardous to health and establishments for food distribution and storages. The issuance of regulations on market and selling products in that public places should depend on the problem of the area. In addition, there should be an exchange of knowledge between LAOs and public health officials on knowledge of public health law, consumer protection in health products and related laws. Collaboration for the control of food safety in Pasang District should be explored.
