บทคัดย่อ
วัตถุประสงค์: เพื่อศึกษาความเป็นมาของกฎหมายยา นโยบาย และมาตรการควบคุมการกระจายยาด้วยการจัดทำบัญชีของร้านขายยา วิธีการ: การวิจัยนี้เป็นการศึกษาเอกสารโดยรวบรวมและทบทวนกฎหมาย นโยบาย และมาตรการที่เกี่ยวข้องเพื่อวิเคราะห์เนื้อหาและสรุปประเด็นโดยประยุกต์ใช้กรอบสามเหลี่ยมนโยบายของ Gill Walk และ Lucy Gilson หลังจากนั้น ผู้วิจัยนำเสนอข้อสรุปเพื่อให้ผู้เชี่ยวชาญพิจารณาให้ความเห็น ผู้เชี่ยวชาญในการวิจัยเป็นเลขานุการและคณะทำงานในการยกร่างกฎกระทรวงเรื่องการขออนุญาตและการออกใบอนุญาตขายยาแผนปัจจุบัน พ.ศ. 2556 และคณะทำงานยกร่างกฎหมายลำดับรองภายใต้กฎกระทรวงดังกล่าว ผลการวิจัย: การกำหนดให้ร้านยาจัดทำบัญชีเริ่มตั้งแต่ปี พ.ศ. 2480 กฎกระทรวงมหาดไทยออกตามความในพระราชบัญญัติควบคุมการขายยา พ.ศ. 2479 กำหนดให้ผู้รับอนุญาตขายยาต้องมีบัญชีแสดงการขายยาอันตราย และการขายยาอันตรายทุกครั้งต้องจดชื่อและที่อยู่ของผู้ซื้อ ชื่อและจำนวนยาที่ขาย และชื่อผู้ขายไว้ในบัญชีแสดงการขายยาอันตรายนั้น ต่อมาได้ยกเลิกการแสดงชื่อและนามสกุลผู้ซื้อโดยกฎกระทรวง ฉบับที่ 2 (พ.ศ. 2510) ออกตามความในพระราชบัญญัติยา พ.ศ. 2510 กฎหมายปัจจุบันกำหนดให้ต้องแสดงชื่อและนามสกุลของผู้ซื้ออีกครั้งในบัญชีการขายยาอันตรายบางรายการเท่านั้น เพื่อแก้ไขปัญหาการนำยาไปใช้ในทางที่ผิด มีผู้แสดงความไม่เห็นด้วยกับรายการยาอันตรายบางรายการที่กฎหมายกำหนดให้ต้องทำบัญชีการขายยาและไม่เห็นด้วยกับการระบุชื่อ-นามสกุลของผู้ซื้อในการทำบัญชี สรุป: เพื่อให้นโยบายและมาตรการควบคุมการกระจายยาโดยการจัดทำบัญชีของร้านขายยาถูกนำไปใช้ได้อย่างมีประสิทธิภาพจึงควรเพิ่มมาตรการบังคับใช้กฎหมาย และประเมินผลนโยบายและมาตรการควบคุมการกระจายยาโดยการจัดทำบัญชีของร้านขายยา
