Analysis of Local Legislations of Sankampaeng District, Chiangmai Province in Accordance with Public Health Law for Regulating Establishments under Food and Drug Laws

Abstract

Objective: To analysis of local legislations of Sankampaeng District, Chiangmai Province In accordance with Public Health Act, B.E. 2535  for regulating establishments under food and drug laws. Methods:  The researcher reviewed the provisions in Public Health Act, B.E. 2535 that regulating the very same establishments that were also under Food Act B.E. 2552 and Drug Act B.E. 2510. The researcher also examined the scope of local legislations of one town municipality and six subdistrict municipalities in Sankampaeng District issued under Public Health Act B.E.2535 for regulating those establishments. The researcher analyzed and figured the inter-relatedness of laws leading to the suggestions for co-operation among relevant regulatory agencies. Results: The chapter on businesses detrimental to health of the Public Health Act B.E.2535 was the legislation granting the authorities to local administrations for licensing and inspection of establishments that were also regulated by food and drug laws. Six municipalities in Sankampaeng district issued local legislation on businesses detrimental to health but had not amended it in accordance to the Declaration in effect of Ministry of Public Health. One Six municipality had not issued this local legislation. Six municipalities with local legislation on businesses detrimental to health included additional provisions on the order issuances of public health officers or local officers. The provisions enabled the officers to establish additional requirements for licensees to follow. Conclusion: Municipalities should issue or amend their local legislations on businesses detrimental to health to be in accordance with the Declaration in effect of the Ministry. Additional provision should require food and drug establishments to be inspected and licensed according to relevant laws under the Ministry of Public Health. Moreover, all local administrations should issue local legislations covering all businesses detrimental to health as specified in the Declaration of Public Health Ministry.
