บทคัดย่อ
วัตถุประสงค์ : เพื่อศึกษาถึงวิธีการของหน่วยงานภาครัฐในการจัดการกับการโฆษณาทางอินเทอร์เน็ตที่ผิดกฎหมายเพื่อขายยาที่ทราบแน่ชัดว่ามีความเสี่ยงต่อผู้บริโภค และเพื่อรวบรวมข้อเสนอแนะในการพัฒนาการดำเนินงานจัดการกับการโฆษณาขายยาทางอินเทอร์เน็ต วิธีการ : ผู้วิจัยรวบรวมรายการยาแผนโบราณที่มีการแจ้งเตือนภัยระหว่างวันที่ 20 ม.ค.2555 ถึง วันที่ 20 มิ.ย. 2557 ว่ามีการปลอมปนสารต้องห้ามจาก www.tumdee.org ของกรมวิทยาศาสตร์การแพทย์ หลังจากนั้นนำชื่อยาดังกล่าวไปค้นหาด้วยกูเกิลเพื่อค้นหาการโฆษณาทางอินเทอร์เน็ตของยาดังกล่าว ผู้วิจัยยังได้สัมภาษณ์พนักงานเจ้าหน้าที่ที่เกี่ยวข้องกับการบังคับใช้กฎหมายกับการโฆษณาขายยาทางอินเทอร์เน็ตทั้งในส่วนของสำนักงานคณะกรรมการอาหารและยา กระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร กรมสอบสวนคดีพิเศษ สำนักงานตำรวจแห่งชาติ และสำนักงานอัยการจังหวัด ผู้วิจัยวิเคราะห์เนื้อหาจากการสัมภาษณ์เพื่อสรุปถึงข้อเสนอแนะในการปรับปรุงวิธีการจัดการกับปัญหานี้ ผลการวิจัย: เว็บไซต์ www.tumdee.org แจ้งเตือนภัยยาแผนโบราณจำนวน 35 รายการ การสืบค้นชื่อยาดังกล่าวด้วยกูเกิล พบมีการโฆษณาขายยาแผนโบราณที่ผิดกฎหมายจำนวน 19 รายการใน 44 เว็บไซด์ ช่องทางติดต่อซื้อขายส่วนใหญ่เป็นสถานที่เดียวกับสถานที่ผลิต การวิจัยไม่พบว่ามีการดำเนินคดีตามกฎหมายกับการกระทำผิดเหล่านี้ การสัมภาษณ์เจ้าพนักงานเจ้าหน้าที่ที่เกี่ยวข้อง พบว่าสำนักงานคณะกรรมการอาหารและยาควรปรับแนวทางการดำเนินงานในเรื่องนี้ให้รวดเร็วขึ้น ประชาสัมพันธ์ให้ผู้บริโภคทราบถึงผลิตภัณฑ์ที่มีอันตราย ชี้แจงให้ผู้ประกอบการผลิตภัณฑ์สุขภาพตระหนักต่อโทษที่จะได้รับหากกระทำผิด และแก้กฎหมายให้ควบคุมการโฆษณาขายผลิตภัณฑ์สุขภาพทางอินเทอร์เน็ตให้ชัดเจน สรุป: ยาแผนโบราณจำนวนมากที่ทางราชการพบว่ามีความเสี่ยงต่อผู้บริโภคยังคงมีการโฆษณาทางอินเทอร์เน็ตโดยไม่ถูกดำเนินการตามกฎหมาย สำนักงานคณะกรรมการอาหารและยาควรเร่งปรับปรุงการดำเนินการจัดการความเสี่ยงในเรื่องนี้
