บทคัดย่อ
บทนำและวัตถุประสงค์: พืชสมุนไพรและพืชให้กลิ่นหอม [Medicinal and Aromatic plants (MAPs)] หลายชนิดถูกคุกคามจากการค้าระหว่างประเทศจนใกล้สูญพันธุ์ อนุสัญญาไซเตสจึงบรรจุพืช MAPs หลายชนิดไว้ในบัญชีแนบท้ายอนุสัญญา ประเทศไทยในฐานะภาคีอนุสัญญาไซเตสต้องให้ความร่วมมือในการควบคุมการค้าพืชในบัญชีไซเตส การศึกษานี้จึงทำการศึกษาการค้าพืช MAPs ในบัญชีไซเตสและผลิตภัณฑ์ในประเทศไทย เพื่อให้ทราบ 1) สถานการณ์การนำเข้าส่งออกพืช MAPs บัญชีไซเตส และผลิตภัณฑ์ 2) ปัญหาในการบังคับใช้กฎหมายภายในประเทศตามบทบัญญัติของอนุสัญญาไซเตส และ 3) เพื่อให้ข้อเสนอแนะในการเพิ่มประสิทธิภาพการควบคุมการค้าพืช MAPs ในบัญชีไซเตส และผลิตภัณฑ์
ระเบียบวิธีศึกษา: การศึกษานี้เป็นการวิจัยแบบผสมวิธี โดยแบ่งเป็นการวิจัยเชิงปริมาณเพื่อศึกษาข้อมูลสถิติการค้าพืช MAPs จากเว็บไซต์ไซเตสและกรมวิชาการเกษตร ส่วนการวิจัยเชิงคุณภาพศึกษาจากการทบทวนวรรณกรรมและการสำรวจการค้าสมุนไพรในแพลตฟอร์มออนไลน์ รวมถึงร้านค้าสมุนไพรภาคสนาม โดยใช้แบบบันทึกข้อมูลและสัมภาษณ์เชิงลึกผู้ประกอบการและพนักงานเจ้าหน้าที่โดยใช้การสัมภาษณ์แบบกึ่งโครงสร้าง
ผลการศึกษา: ผลการสำรวจการค้าพืช MAPs พืชในบัญชีไซเตสพบจำนวน 31 ชนิด จำหน่ายในลักษณะเครื่องยาสมุนไพร สารสกัด ยาสมุนไพรสำเร็จรูป และเครื่องสำอาง การค้าในช่องทางออนไลน์มีความหลากหลายของชนิดและผลิตภัณฑ์มากกว่าที่จำหน่ายในร้านค้าภายในประเทศ ชนิดพืชที่พบบ่อย ได้แก่ โสมเกาหลี โสมอเมริกา โกฐกระดูก กฤษณา กล้วยไม้สกุลหวาย และพบว่ามีการระบุชนิดพืชบางชนิดไม่ตรงกับตัวอย่างพืช จากสถิติการค้าพืช MAPs ในบัญชีไซเตสจากเว็บไซต์ไซเตสระหว่างปี พ.ศ. 2563-2565 ประเทศไทยมีการส่งออกพืช MAPs มากที่สุด ร้อยละ 49 ของปริมาณการส่งออกของโลก ชนิดพืชที่ส่งออกปริมาณมาก ได้แก่ กล้วยไม้ลูกผสมสกุลหวาย และในช่วงเวลาดังกล่าวมีรายงานการส่งออกพืช MAPs ของประเทศภาคีมายังประเทศไทยจำนวน 158 ครั้ง 35 ชนิด ในขณะที่ประเทศไทยมีรายงานการนำเข้าจำนวน 43 ครั้ง 21 ชนิด ข้อมูลที่ได้จากการสัมภาษณ์ผู้ที่เกี่ยวข้องพบว่ายังขาดความรู้ความเข้าใจเกี่ยวกับชนิดพืช MAPs ที่อยู่ในการควบคุมของอนุสัญญาไซเตส และกฎระเบียบในการควบคุมการค้าพืช MAPs ในบัญชีไซเตส
อภิปรายผล: การศึกษาครั้งนี้ทำให้ทราบว่าการควบคุมการค้าพืช MAPs ที่อยู่ในบัญชีไซเตสและผลิตภัณฑ์ในประเทศไทยยังมีประสิทธิภาพไม่เพียงพอ ซึ่งไม่ใช่เพราะกฎหมายภายในประเทศมีข้อบกพร่อง แต่ส่วนหนึ่งเนื่องจากผู้มีส่วนเกี่ยวข้องยังขาดความรู้และความเข้าใจเกี่ยวกับการค้าพืช MAPs ในบัญชีไซเตสและผลิตภัณฑ์และกฎหมายที่เกี่ยวข้อง
ข้อสรุปและข้อเสนอแนะ: ควรเพิ่มประสิทธิภาพการควบคุมการค้าพืช MAPs และผลิตภัณฑ์โดยการจัดทำฐานข้อมูลชนิดพืช MAPs ที่อยู่ในบัญชีไซเตส และบูรณาการข้อมูลระหว่างหน่วยงานที่เกี่ยวข้อง นอกจากนี้ ควรฝึกอบรมและให้ความรู้แก่พนักงานเจ้าหน้าที่และผู้ประกอบการที่เกี่ยวข้องเกี่ยวกับวิธีปฏิบัติที่ถูกต้องตามกฎหมายควบคุมการค้าพืช MAPs ในไซเตส
