การพัฒนาระบบแผนการดูแลเพื่อการฟื้นฟูความสามารถในการต่อสู้คดีของผู้ป่วยนิติจิตเวช

วัตถุประสงค์ : เพื่อพัฒนาและทดลองใช้ระบบแผนการดูแลเพื่อการฟื้นฟูความสามารถในการต่อสู้คดีของผู้ป่วยจิตเวชที่มีคดี
วิธีการ : การวิจัยและพัฒนา 5 ขั้นตอน ได้แก่ 1) การวิเคราะห์ความต้องการและความจำเป็นในการพัฒนาระบบ 2) การกำหนดกรอบแนวคิดในการพัฒนาระบบ 3) การจัดทำต้นร่างระบบด้วยกระบวนการ appreciation-influence-control ร่วมกับทีมสหวิชาชีพด้านนิติจิตเวช 4) การตรวจสอบคุณภาพทางวิชาการ และ 5) การทดลองใช้ในผู้ป่วยจิตเวชที่มีคดีจำนวน 3 ราย ประเมินผลจากความสามารถในการต่อสู้คดีภายใน 90 วัน และความสอดคล้องของการประเมินระหว่างจิตแพทย์ 2 คน
ผล : ร่างระบบแผนการดูแลประกอบด้วยแนวทาง 4 ส่วน ได้แก่ 1) เกณฑ์การประเมินอาการทางจิตเวชที่สอดคล้องกับเกณฑ์การประเมินความสามารถในการต่อสู้คดี รวม 16 อาการ 2) การดูแลผู้ป่วยตามระยะในสถานบำบัดรักษา ร่วมกับการกำหนดบทบาทของสหวิชาชีพ 3) การดูแลรักษาตามประเด็นปัญหา และ 4) การประชุมติดตามความก้าวหน้า การทดลองใช้ในกลุ่มตัวอย่างพบว่า มี 2 รายที่มีความสามารถในการต่อสู้คดีภายใน 90 วันหลังรับไว้รักษา ส่วนอีก 1 ราย ซึ่งมีความเจ็บป่วยเรื้อรังและความบกพร่องด้านการรู้คิด ยังไม่มีความสามารถในการต่อสู้คดีภายใน 180 วัน การประเมินความสามารถในการต่อสู้คดีของจิตแพทย์มีความสอดคล้องกัน โดยมีค่าสัมประสิทธิ์แคปปาของโคเฮนเท่ากับ 1.0
สรุป : ระบบที่พัฒนาขึ้นนี้ช่วยฟื้นฟูความสามารถในการต่อสู้คดีของผู้ป่วยนิติจิตเวชภายใน 90 วัน และเป็นแนวทางมาตรฐานสำหรับจิตแพทย์และสหวิชาชีพในการประเมินและฟื้นฟูความสามารถในการต่อสู้คดี ทั้งนี้ ควรมีการทดลองใช้เพิ่มเติมในสถานบำบัดรักษาอื่น ๆ และในกลุ่มประชากรที่หลากหลาย เพื่อยืนยันถึงประสิทธิผลและความเหมาะสมของระบบในบริบทที่แตกต่างกัน
