The Victims of Abortion Cases in the Book of Exodus and Perspective from Thai Law

Abstract

           More two thousand aborted infant corpses were found November 19, 2010 in Bangkok. An investigation revealed that the dead fetuses had been aborted, and then wrapped in plastic bags and left in the temple. Thus this is the criminal case that rises up the question about “Rechtsgut.” In the scripture,  the author did not explain clearly concerning the victims in the abortion case, woman or her fetus. In this article, the writer will use Thai criminal law to explain the Rechtsgut of the abortion case in the Book of Exodus. In this study, the writer will explain this article in three sections. In the first part of this essay, the writer will briefly introduce the Book of Exodus 21:22-25 and the understanding about abortion case in Ancient Near East. Then, the writer will focus on Thai criminal law and the Rechtsgut of the abortion cases and battery cases. In the Third part of this essay, the writer recommends a new interpretation and concludes the victims of abortion case in the Book of Exodus 21:22-25.”
